ASSISTANCE IN ADMINISTRATIVE PROCESS

In 2005 a system of administrative procedure began to function in Ukraine. Its major mission is to defend rights, freedoms and interests of physical entities, rights and interests of legal entities in the sphere of public-legal relations from violations on the part of public authorities, local governments, their officials and others executives when they perform their managerial functions.

Any claims and complaints concerning the actions of various official executives will be tried in administrative courts except for those which require different procedure of appeal.

The disputes with labor and social care departments concerning the payment of social benefits, social after-payment to wages, disputes with the offices of the Pension Fund of Ukraine as to readjustments of pensions, additional pensions (namely, children of war time, those who suffered from Chornobyl catastrophe), disputes with housing departments of local state administrations as to the list of people who have housing needs – all of them will be considered in administrative procedure. 

When the case is tried in the administrative court, the parties of the administrative process can use legal assistance which is envisaged by the current legislature; the assistance can be provided by a lawyer or an individual who is an expert in law and has a legal right to provide this service.
