Private property is one of the forms of ownership which means an absolute, legally protected right of a citizen or a legal entity of particular asset (land, real estate, means of production, money and securities, goods, intellectual product); this implies that these objects of the ownership belong to private individuals, families, groups of individuals. Article 41 of the Constitution confirms private property right of the citizens, the right to have assets in possession: to own, to use and dispose of it at his/her discretion. Private property right is inviolable, including the right of real estate.

As a rule, real estate is the most valuable share of every citizen’s property, one of the most important means to run business. Operations associated with real estate (availability, change, transfer, termination of the property right), taking into account its value, have their peculiarities, stated by law, and they are realized through particular procedures which are not necessary for other categories of the asset, namely, public registration of the property right in the Inventory Office, a notarized transfer certificate. Disputes concerning this category of property also have their peculiar aspects.
